ضوابط وشروط وأحكام المستخدم لتطبيق إديوستيشن

تمثل هذه الضوابط والشروط اتفاق رسمي “عقد” بين منصة إديوستيشن والعملاء "المستخدمين" لمنصة إديوستيشن والذي هو عبارة عن منصة تشاركية تبسط مفهوم التدريب التعاوني وفق تنمية الاقتصاد المعرفي بين الطلاب الجامعيين وخريجي الثانوية وبين سوق العمل محليا واقليمياً عبر طرح مهارات ميدانية يومية بنظام الساعات تصل لكل طالب مسجل وفقا لتخصصه وميوله الأكاديمي والمواد التي يدرسها لربطه بيئة عمل مثالية تقدم له الدعم والاسناد اللحظي من واقع متغيرات ومتطلبات السوق المحلية والعالمية.

إن أي استخدام من قبلك للخدمات التي يوفرها تطبيق إديوستيشن يشكل موافقة منك على هذا العقد وأحكامه، وأنك تفهم وتقبل أن تطبيق إديوستيشن ليس مؤسسة تعليمية أو جامعة أكاديمية، وبالتالي فإن تطبيق إديوستيشن ليس مسؤول عن جودة الخدمة التي يقدمها شركائنا، ولا المحتوى الذي ينشرونه على منصتنا.

 وتبعاً لذلك يجب عليك عدم استخدام المنصة في حال لم تكن موافقاً على الأحكام والشروط الواردة في هذا العقد.

كما يحتفظ التطبيق بحق تعديل أو تغيير هذه الأحكام والشروط دون إخطار مسبق، ويكون من مسؤوليتك كمستخدم للتطبيق مراجعة ضوابط وشروط الاستخدام بشكل دوري لمعرفة التحديثات التي تطرأ على الأحكام والشروط هذه، من خلال الرابط (https://www.edustation.app/terms) كما نأمل مراجعة سياسة الخصوصية لدينا لمعرفة المزيد حول كيفية استخدام التطبيق للمعلومات التي تقدم لنا من قبل المستخدمين.
الشروط:

• نعم، أدرك تمامًا أن جميع المحتويات المتداولة عبر تطبيق إديوستيشن تعد مسؤولية مبتكرها.

"بصفة أكثر دقة، أنت - كمستخدم - تتحمل المسؤولية الكاملة عن المحتوى الذي تقوم بنشره أو إرساله أو توفيره بأي شكل آخر عبر تطبيقنا."

• أدرك أن إديوستيشن لا يسيطر على المحتوى الذي يتم توفيره عبر التطبيق ولا يتحمل مسئولية أي نتائج تنشأ عن استخدام هذا المحتوى.
• من خلال استخدامي لتطبيق إديوستيشن، أقر بأنه قد يكون هناك محتوى يتسم بالسلبية أو الغير لائق أو الغير دقيق أو الضليل، وأنني أتحمل المسؤولية الكاملة لتقييم وتحمل المخاطر المرتبطة بذلك.
• أدرك أن إديوستيشن لن تكون مسؤولة بأي شكل من الأشكال عن أي محتوى أو عن أي خسارة أو ضرر يتكبده المستخدم نتيجة استخدام أي محتوى منشور عبر التطبيق.
• أدرك تمامًا أن إديوستيشن لا تقوم بفحص المحتوى مسبقًا أو الموافقة عليه، ولكن يحق للمسؤول في إديوستيشن (وليس بالتزام) وفقًا لتقديره الخاص، رفض أو حذف أو نقل أي محتوى متاح عبر الخدمة، في حال انتهاك نص أو روح الشروط أو لأي سبب آخر.
• أُقر وأوافق على أنه يمكن لإديوستيشن وفقًا لتقديرها الخاص، الاحتفاظ بالمحتوى أو الكشف عنه، بما في ذلك عناوين البريد الإلكتروني وعناوين IP والطوابع الزمنية ومعلومات المستخدم الأخرى، إذا كان ذلك مطلوبًا بموجب القانون أو بحسن نية.
• أوافق على أن هذا الاحتفاظ أو الكشف قد يكون ضروريًا بشكل معقول للامتثال للإجراءات القانونية، أو فرض الشروط، أو الرد على الادعاءات حول انتهاك حقوق الأطراف الثالثة، أو حماية حقوق أو ممتلكات أو سلامة إديوستيشن، أو مستخدميها، أو الجمهور.

• المحتوى الذي يتم عرضه على الخدمة أو من خلالها محمي بموجب حقوق الطبع والنشر كعمل جماعي و/أو تجميع، وفقًا     لقوانين حقوق النشر والاتفاقيات الدولية. أوافق على عدم إعادة إنتاج أو تكرار أو نسخ المحتوى من الخدمة، وأوافق على الالتزام بأي إشعارات حقوق نشر معروضة على الخدمة.

مبادئ الاستخدام والسياسات السلوكية:

 في حالة استخدامك لتطبيق إديوستيشن فأنت توافق على عدم نشر محتوى يتضمن:

• محتوى إباحي.
• محتوى متعلق بالمقامرة.
• معلومات حول المخدرات أدواتها.
• معلومات عن القرصنة.
• مبيعات الأدوية الموصوفة.
• محتوى عنيف.
• استخدام لغة نابية مفرطة.
• محتوى يتعلق بالبرامج التي تعوض المستخدمين عن النقر على الإعلانات وما يشبها من بحث وغيرهم.
• أي محتوى غير قانوني يروج لأنشطة غير قانونية أو ينتهك حقوق الآخرين.
• مبيعات المنتجات المقلدة أو المزورة.
• محتوى يشكل تهديدًا أو يسيء استخدامًا أو يتداول معلومات خاصة.
• محتوى ينتحل شخصية آخرين.
• محتوى بيع الأسلحة أو الذخيرة
• محتوى يحتوي على فيروسات برامج أو رموز أو ملفات تهدد أمن البرامج الحاسوبية أو الأجهزة الإلكترونية
• محتوى يتعلق بالبرامج التي تعوض عن عمليات البحث أو تصفح الويب أو قراءة البريد الإلكتروني.
• إعلانات غير مصرح بها أو مواد ترويجية غير مرغوب فيها.
• روابط إلى خدمات تجارية غير مسموح بها.
• محتوى يتضمن منتجات تبغ أو مشروبات كحولية أو مستحضرات صيدلانية أو عقاقير غير مشروعة،
• محتوى يروج لعناصر مسروقة أو مقلدة، أو عروض خدمات غير موجودة
• محتوى ينتهك حقوق البراءات، أو العلامات التجارية، أو الأسرار التجارية، أو حقوق النشر، أو أي حقوق ملكية أخرى لأي طرف
• محتوى يتضمن معلومات شخصية أو تعريفية عن شخص آخر دون موافقة صريحة من هذا الشخص.
• أوافق على عدم نشر محتوى يخترق حقوق الطبع والنشر أو العلامات التجارية أو الأسرار التجارية أو أي حقوق ملكية أخرى.
• أوافق على عدم التسبب في تعطيل التواصل الطبيعي والفعال عبر الخدمة، وذلك من خلال إرسال عدد زائد من الرسائل في فترة زمنية قصيرة.
• أوافق على عدم التواصل مع أي شخص رغم طلبه بعدم الاتصال به.
• أوافق على عدم مطاردة أو تحريض أي شخص.
• أوافق على عدم جمع البيانات الشخصية للمستخدمين الآخرين لأغراض تجارية أو غير قانونية.
• أوافق على عدم استخدام وسائل الأتمتة، مثل العناكب أو الروبوتات أو برامج الزحف أو أدوات استخراج البيانات، لتنزيل البيانات من الخدمة -باستثناء محركات البحث على الإنترنت "مثل: Google والمحفوظات العامة غير التجارية "مثل: org".
• عند نشر المحتوى في أي منطقة عامة على الخدمة، فإني أوافق أنا كمستخدم على منح تطبيق إديوستيشن تلقائيًا كافة الحقوق اللازمة لحظر أي تجميع أو عرض أو نسخ أو تكرار أو إعادة إنتاج أو استغلال لاحق للمحتوى من قبل أي طرف لأي غرض.

إخلاء المسؤولية:

أنت تدرك وتوافق على النقاط التالية:

• يُنكِر من قِبل تطبيق إديوستيشن أي ضمانات، سواء كانت صريحة أو ضمنية.
• تتمثل طبيعة الخدمة في توفيرها "كما هي" و "حسب توفرها"، وعليك تجنب الاعتماد الكلي عليها.
• يكون استخدامك للخدمة تحت مسؤوليتك الشخصية، ويخلي تطبيق إديوستيشن نفسه من أي مسؤولية تجاه الأضرار المباشرة أو غير المباشرة أو العرضية أو الخاصة أو التبعية أو النموذجية (حتى في حال تلقيه إخطارًا بإمكانية حدوث مثل هذه الأضرار).
• يُعد أي ضمان آخر غير منصوص عليه في هذه الشروط، بما في ذلك أي ضمان من جانب موظفي تطبيق إديوستيشن، غير صالح.
• في حالة عدم صحة أي من الأحكام المذكورة أعلاه وفقًا للقانون، يكون تحملنا للمسؤولية محدودًا وفقًا للحدود المقررة قانونيًا.

التعويضات:

 

• أنت توافق على تعويض تطبيق إديوستيشن ومسؤوليه وموظفيه عن أي مطالبة أو طلب، بما في ذلك أتعاب المحاماة المعقولة، قد يقدمها أي طرف ثالث نتيجةً للمحتوى الذي ترسله أو تنشره أو توفره عبر الخدمة، أو استخدامك للخدمة، أو انتهاكك للشروط، أو انتهاك حقوق الآخرين.

الروابط:

• قد يوفر تطبيق إديوستيشن، أو قد توفر أطراف ثالثة، روابط لمواقع أو موارد أخرى على شبكة الإنترنت. نظرًا لأن تطبيق إديوستيشن لا يتحكم في هذه المواقع والموارد، فإنك تقر وتوافق على أن تطبيق إديوستيشن ليس مسؤولًا عن توفر مثل هذه المواقع أو الموارد الخارجية، ولا يصادق عليها وليس مسؤولاً عن أي محتوى أو إعلان أو منتجات أو مواد أخرى موجودة أو متاحه من هذه المواقع أو الموارد.
• أنت تقر وتوافق أيضًا على أن تطبيق إديوستيشن لن يكون مسؤولًا مباشرة أو غير مباشرة عن أي ضرر أو خسارة يزعم أنه ناجم عن أو فيما يتعلق باستخدام أو الاعتماد على أي محتوى أو سلع أو خدمات متاحة عليه أو من خلال أي موقع أو مورد من هذا القبيل.معلومات:
• تشكل هذه الشروط الاتفاقية الكاملة بينك وبين تطبيق إديوستيشن، وتحكم استخدامك للخدمة، وتحل محل أي اتفاقيات سابقة بينك وبين تطبيق إديوستيشن.
• كما تخضع الشروط والعلاقة بينك وبين تطبيق إديوستيشن لقوانين الدولة بغض النظر عن تعارضها مع أحكام القانون.
  توافق أنت وتطبيق إديوستيشن على الخضوع للاختصاص الشخصي والحصري للمحاكم الموجودة داخل المقاطعة.
• لا يشكل فشل تطبيق إديوستيشن في ممارسة أو إنفاذ أي حق أو حكم من الشروط تنازلاً عن هذا الحق أو الحكم.
•  
• إذا وجدت محكمة ذات اختصاص قضائي أن أي بند من الشروط غير صالح، يتفق الطرفان على أن المحكمة يجب أن تسعى إلى تفعيل نوايا الأطراف كما هو موضح في الحكم، وتظل الأحكام الأخرى للشروط سارية المفعول والتأثير الكامل.
• توافق على أنه بغض النظر عن أي تشريع أو قانون يتعارض مع ذلك، يجب تقديم أي مطالبة أو سبب دعوى ناشئة عن أو تتعلق باستخدام الخدمة أو الشروط في غضون عام واحد (1) بعد ظهور هذه المطالبة أو سبب الدعوى أو يتم حظرها إلى الأبد.

Guidelines and User Terms and Conditions for the EduStation APP

These terms and conditions constitute a formal agreement "contract" between the EduStation platform and the users ("customers") of the EduStation platform. It is a collaborative platform that simplifies the concept of cooperative training according to the development of the cognitive economy between university students, high school graduates, and the local and regional job market. It achieves this by offering daily field skills based on an hourly system for each registered student, according to their specialization, academic interests, and the subjects they are studying, connecting them to an ideal work environment that provides instant support and alignment with the changing requirements of the local and global job market

Any use by you of the services provided by the EduStation application constitutes your consent to this contract and its terms. You understand and accept that EduStation is not an educational institution or an academic university; therefore, EduStation is not responsible for the quality of the services provided by our partners or the content they publish on our platform. Consequently, you should not use the platform if you do not agree to the terms and conditions outlined in this contract

The application reserves the right to modify or change these terms and conditions without prior notice. It is your responsibility as a user of the application to periodically review the terms and conditions of use to be aware of any updates. Terms

Yes, I fully understand that all content circulated through the EduStation application is the responsibility of its creators. More precisely, as a user, you bear full responsibility for the content you publish, send, or provide in any other form through our application

I understand that EduStation does not control the content provided through the application and is not responsible for any results arising from the use of this content

By using the EduStation application, I acknowledge that there may be content characterized by negativity, inappropriateness, inaccuracy, or obscurity, and I assume full responsibility for evaluating and bearing the risks associated with that

I fully understand that EduStation will not be responsible in any way for any content or for any loss or damage incurred by the user because of using any content published through the application

 

I fully understand that EduStation does not pre-examine or approve content, but it is the right of the EduStation administrator (without obligation) at their discretion to reject, delete, or move any content available through the service, if it violates the letter or spirit of the terms or for any other reason

I agree that EduStation may, at its discretion, retain or disclose content, including email addresses, IP addresses, timestamps, and other user information, if required by law or in good faith.

I agree that this retention or disclosure may be reasonably necessary to comply with legal procedures, enforce terms, respond to claims of third-party rights violations, or protect the rights, property, or safety of EduStation, its users, or the public.

While EduStation does not claim ownership of user-posted content, by posting content in any public area of the service, you automatically grant a worldwide, irrevocable, fully paid, non-exclusive, and perpetual license to use, copy, perform, display, distribute, and prepare derivative works from it or incorporate it into other works. Additionally, you will defend and indemnify EduStation against any third-party claims related to the breach of any of the foregoing representations and warranties

The content displayed on the service is protected by copyright as a collective and/or compilation work, according to copyright laws and international agreements. I agree not to reproduce, duplicate, or copy content from the service and agree to comply with any copyright

Principles of Use and Behavioral Policies

In the event of your use of the EduStation application, you agree not to publish content that includes

Pornographic, explicit, or mature content

Content related to gambling or casinos

Information about illegal drugs or their tools

Information about piracy or hacking

Sales of prescription drugs

Violent content

Excessive use of offensive language

Content related to programs that compensate users for clicking on ads and the   

Any illegal content promoting unlawful activities or violating the rights of others

Sales of counterfeit or forged products

Content that poses a threat, misuse, or disseminates private information

Content impersonating others

Content selling weapons or ammunition

Content containing viruses, program codes, or files that threaten the security of computer programs or electronic devices

Content related to programs that replace search, web browsing, or email reading operations

Unauthorized ads or unwanted promotional materials

Links to prohibited commercial services

Content including tobacco products, alcoholic beverages, pharmaceuticals, or illegal drugs

Content promoting stolen or counterfeit items, or non-existent service offerings

Content violating patent rights, trademarks, trade secrets, copyrights, or any other intellectual property rights of any party

Content containing personal or identifying information about another person without their explicit consent

I agree not to post content that breaches copyright, trademarks, trade secrets, or any other proprietary rights

I agree not to disrupt natural and effective communication through the service by sending an excessive number of messages in a short period

I agree not to communicate with any person despite their request not to be contacted

I agree not to stalk or incite any person

I agree not to collect personal data of other users for business or illegal purposes

I agree not to use automation tools such as spiders, robots, crawling programs, or data extraction tools to download data from the service, except for internet search engines such as Google and non-commercial public archives such as archive.org

When posting content in any public area of the service, I, as a user, agree to automatically grant EduStation all necessary rights to block any aggregation, display, copying, reproduction, or subsequent exploitation of the content by any party for any purpose

Disclaimer

:You acknowledge and agree to the following points 

EduStation application disclaims any warranties, whether express or implied

The nature of the service is provided "as is" and "as available," and you should avoid relying entirely on it

Your use of the service is at your personal responsibility, and EduStation disclaims any liability for direct, indirect, incidental, special, consequential, or exemplary damages (even if notified of the possibility of such damages)

Any other warranties not expressly stated in these terms, including any warranties by EduStation employees, are invalid

In the event that any of the above provisions is deemed invalid under the law, our liability is limited within legally established limits

Compensation

You agree to indemnify EduStation, its officials, and employees for any claims or demands, including reasonable attorney fees, made by any third party as a result of the content you submit, post, or provide through the service, or your use of the service, or your violation of the terms, or your violation of the rights of others

EduStation may provide, or third parties may provide, links to other websites or resources on the Internet. Since EduStation does not control these sites and resources, you acknowledge and agree that EduStation is not responsible for the availability of such external sites or resources and does not endorse them and is not responsible for any content, advertising, products, or other materials available or provided through such sites or resources

You also agree that EduStation shall not be responsible, directly or indirectly, for any damage or loss alleged to be caused by or in connection with the use or reliance on any content, goods, or services available on or through any such site or resource

Information

These terms constitute the entire agreement between you and EduStation, governing your use of the service, and replace any previous agreements between you and EduStation

The terms and the relationship between you and EduStation are subject to the laws of the state regardless of its conflict of laws provisions

You and EduStation agree to submit to the personal and exclusive jurisdiction of the courts located within the province

Failure by EduStation to exercise or enforce any right or provision of the terms shall not constitute a waiver of such right or provision

If any provision of the terms is found by a court of competent jurisdiction to be invalid, the parties agree that the court should seek to enforce the intentions of the parties as reflected in the provision, and the other provisions of the terms remain in full effect and force.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the service or the terms must be filed within one (1) year after such claim or cause of action arose or be forever barred
